Second, the law in Minnesota requires that any settlement of the child’s injury case must be approved by a court. It is the court’s responsibility to verify that the settlement is fair for the child.

Third, in most cases, the settlement for the child’s accident injury will not be available to the child or parents until the child is at least 18 years old. Of course, there are exceptions if a child has specific needs. However, a judge must agree that the money is needed sooner for the benefit of the child. The settlement money also must be invested in a very safe way (bank deposit, insurance annuity, etc.).

While age 18 is the earliest the money can be available to the child, the settlement can be structured so it is not available until later. For example, the parents may structure payments to the child yearly starting age 18, or not start until age 22 when the child graduates college. This may allow the child and family to still qualify for financial aid.
