MN LAWYERS FOR CHILD INJURY
There is nothing harder for a parent than a sick or injured child. You only want the best for your child. You want to take care of them and protect them, and to keep them safe and healthy. Our Minnesota personal injury lawyers have represented many parents whose child was injured in an accident. Our child injury attorneys have represented the parents and child where the child was injured in a car accident, injured at a daycare, at school, at a store, because of a dog bite or dog attack, and many other situations.
When a child is injured in an accident, there are several significant legal issues to be considered, which a lawyer will discuss in detail with you when you call our office. First, although the child has suffered the injury, the parents are still responsible for the medical bills. Therefore, when our injury lawyers work on a case where a child has been injured, we represent the child first, but we also make sure that the parents are reimbursed for their expenses including medical bills. Second, the law requires that any settlement of the child’s injury case must be approved by a court – it is the court’s responsibility to verify that the settlement is fair for the child. Third, any settlement for the child’s injury will generally not be available to the child or parents until the child is at least 18 years old, unless a judge agrees that the money is needed sooner for the benefit of the child. The settlement money must be invested in a very safe way (bank deposit, insurance annuity, etc.) and the investment can only be in the injured child’s name and can only be withdrawn starting at age 18. However while age 18 is the earliest the money can be available to the child, the settlement can be structured so it is not available until later or not all at once. For example, the parents may have the payments to the child be yearly starting age 18, or not start until age 22 when the child graduates college so that the child and family can still qualify for financial aid. These are issues that a Minnesota child injury lawyer will discuss with you in more detail when you call our office.
