What if Two Cars Are Partly at Fault for Accident?

THREE CAR ACCIDENT – INSURANCE COMPANY ASSIGNS FAULT

What happens if three cars are in an accident?  Our lawyers have handled many three car crashes. In fact, we mave handled crashes involving four or more vehicles as well. I many cases, the multi car crashes are rear end pileups. However, there are other situations as well. For example, we often see situations where a car pulls out from a parking lot, hits a a car and pushes that car into another car. Unfortunately, the insurance issues in these cases can get complicated. The two primary issues are (1) What if there is not enough insurance, and (2) the insurance companies disagree about who was at fault.

IS THERE ENOUGH INSURANCE FOR MULTI VEHICLE CRASH?

When one vehicle is clearly responsible for the multi car crash, there may not be enough insurance. The first issue is damage to the car. Typically, the property damage coverage for a car accident is $25,000 to $100,000. Unfortunately, that amount is rarely enough when two or more cars are damaged. Of course, if you have full coverage on your car, this won’t be a problem for you. However, if you have liability only, you are relying on the car that caused the crash to pay, and they may not have enough if there is significant damage to two or more other cars.

The same is true if there are several people are seriously injured or killed. The person who caused the crash will have a limited amount of insurance and it might not be enough to cover all the injuries. Fortunately, every insurance policy in Minnesota comes with underinsured coverage. Therefore, you will have at least some additional injury insurance from your own policy. Our car accident injury lawyers work with these claims every day.

INSURANCE COMPANIES DISAGREE ABOUT FAULT IN THREE CAR ACCIDENT

Another problem our lawyers frequently see is the insurance companies arguing about which car was at fault. With a three car crash, they will often say two cars had at least some fault. In fact, even when a car suddenly pulls out of a parking lot onto the street or changes lanes into another car, the insurance company will sometimes argue that the second car was partly at fault. Of course, this often doesn’t make sense, but it is an issue our lawyers have to deal with for our client.
