WHAT IF I WAS IN A CAR ACCIDENT DRIVING BORROWED CAR?
Our car accident lawyers handle injury cases throughout Minnesota. One question we frequently get is, “what if was in a car accident while driving a borrowed car?” In most cases, the answer is that auto insurance will cover you the same as if you owned the car. However, that is not always true.
First, Minnesota is a “No-Fault” state. What means your own auto insurance pays for your medical bills and lost wages. It doesn’t matter if the other car was at fault or you were driving a car you borrowed – your insurance has primarly responsibility. However, if you don’t have your own auto insurance, the insurance for the car you were in will pay.

What about damage to the car you borrowed? First, it depends on which vehicle was at fault. If the other car was at fault, their insurance will pay to fix or replace the car. The fact that you were driving and borrowed the car doesn’t mean anything.
However, what if you were at fault in the accident? In that case, your auto insurance will pay. If you don’t have auto insurance, then the vehicle’s owner’s insurance will pay if they have collision coverage. Of course, there are some exeptions. Most importantly, if you regularly drove the borrowed car, the owner’s insurance will revoke coverage. The reason for this is that they did not agree to cover a regular additional driver. The insurance will only cover the accident if the driver was a very ocassional borrowed of the car.
