A trooper, responding to the crash report, discovered the road worker down in a ditch. The trooper saw tire tracks in the dirt, indicating that the driver got back on the road and continued north. A piece from the driver’s vehicle left at the scene was a match.
A witness traveling in the same direction reported seeing the vehicle using the shoulder to pass slower traffic. Law enforcement stopped the driver on I-35 near Moose Lake, detecting the smell of alcohol. The driver claimed to have taken sleeping pills and had three glasses of wine the previous day. A preliminary breath test measured his blood alcohol content at 0.143%. This is more than 1 1â„2times the legal limit for driving in Minnesota.
