WHAT IF THERE IS NOT ENOUGH INSURANCE IN MULTI CAR CRASH?
What can you do if there are multiple cars damaged by one car at fault and that car doesn’t have enough insurance? Our car accident lawyers have had this issue come up several times recently. Many auto insurance policies come with $25,000 or less of property damage coverage. (In fact, we recently had a case where the other car only had $10,000 insurance for property damage.) However, any car accident can result in damage exceeding that amount. If there are multiple cars damaged, it is even more likely there will not be enough insurance to pay for all the damage.
Of course, if you have full coverage on your car, your insurance will pay for your vehicle damage. But what if you have liability only coverage? First, the insurance for the driver at fault will offer to divide up their insurance money proportionately among the damaged cars. That requires a basic math calculation our lawyers can explain to you when you call our office. Unfortunately, that also means you will not get the full value of your car or full payment for the repairs.

Your options in this situation are not good. Basically, you can sue the other driver for the damage to your car. The problem is that this takes a long time and you have the risk of not collecting any judgment. Also, if you were injured in the accident, you are required to start your injury case with your damage case. However, your injury case will not be ready to start until you are done with all medical treatment and your injuries are fully understood.
