Minnesota Statute 347.22 states: If a dog, without provocation, attacks or injures any person who is acting peaceably in any place where the person may lawfully be, the owner of the dog is liable in damages to the person so attacked or injured to the full amount of the injury sustained.

The statute means the dog owner doesn’t have to do anything wrong, they are automatically responsible. It doesn’t matter if the dog owner had an electric fence and tried to keep the dog in the yard. You don’t have to it was the dog owner’s fault. They are responsible because it it their dog. The only exceptions are if you were trespassing or provoked the dog.

Most of the time, when a dog gets past an electric fence, it attacks someone on the street. For example, if someone is walking their own dog past the house. In fact, we have had that exact case many times. The person walking past the house may try to protect their own dog and get injured that way. Or, the dog just immediately attacks the person.
