Accident Caused By Unsecured Material On Truck – MN Lawyers

A recent news article reported that a Wahpeton MN man was taken by ambulance to CHI St. Francis in Breckenridge, Minnesota, after being extricated from his vehicle following a multi-vehicle accident Monday morning. The accident was caused when a vehicle was rear ended on the 210 Bypass, pushed off the road and hitting a car parked in the driveway of a nearby home.

According to the MN State Patrol, the car that started the accident was passing a truck on the bypass as the truck driver was picking up a load of foam wrapping that had flown off his flatbed delivery truck. The police said that although the load was secured, it was also shrink-wrapped, and the shrink wrap had “given way” prior to the accident and material fell off the truck. When the car came around the payloader truck, the driver saw the other car stopped in the driving lane of Highway 210 waiting to make its turn.

An accident can occur when something falls of a truck, when the truck tips because it was not loaded properly, or because something extends out too far from the truck and causes an accident when the truck makes a turn.  It is often an improper payloader type truck that causes these accidents because the cargo is not enclosed and improperly secured.

Our lawyers have also had cases where something fell off of a pickup truck onto the road and caused an accident. Sometimes our client’s car will hit something that fell into the highway or road. Many times, we do not even initially know how the debris in the road got there, and a car accident lawyer has to find evidence that it was because of a truck or another vehicle.
