Our lawyers are frequently asked for advice about medical treatment. Most often, “should I get surgery.” Since we are not doctors, we do not give medical advice. However, we do give legal advice, and we understand insurance issues. One frequent question is whether you should get a second doctor’s opinion. Also, will insurance pay for a second opinion after an accident?

When you are injured in an accident, insurance usually pays for your medical treatment. For example, if you are injured at work, there is workers compensation. Likewise, in a car accident there is auto insurance. If you have health insurance or Medicare, they will also pay medical bills after an accident injury.

No matter who is paying your medical bills, most insurance companies will pay for a second opinion. A second opinion is in their best interest as well as yours. A correct diagnosis and treatment is better for everyone. They do not want to pay for unnecessary surgery, and you don’t want to have it. Likewise, they don’t want you being strung along with ineffective alternative treatment. You want to get better, and they want you to get better. If you want a second opinion, they will probably pay for it.

WHEN SHOULD YOU GET A SECOND DOCTOR OPINION

Our injury lawyers frequently recommend clients get a second doctor’s opinion. In a surgical situation, it almost always makes sense unless the surgery is urgent. Every surgery carries risks, including the possibility it will not be effective. You should not go through it unless you are confident the benefits outweigh the risks. You will have more confidence in the decision when you get a second opinion from a doctor who gives the same advice.

In addition, a second opinion is needed if you are not seeing improvement. For example, chiropractic treatment or physical therapy works in many situations. However, not always. If you are getting treatment for more than a month but are not seeing improvement, a second opinion may be warranted.
