DOES YOUR INSURANCE PAY WHEN CAR ACCIDENT NOT YOUR FAULT?
The answer to this question is yes. Your auto insurance pays certain benefits regardless of fault. That is what ‘No-Fault‘ means. People injured in a car accident are entitled to have their medical bills paid and wage loss reimbursed. Those benefits come from your auto insurance regardless of fault. Also, you should not need a lawyer for that. Unfortunately, sometimes the insurance refuses to pay obvious claims. Of course, our lawyers will get involved in those situations. However, most of the time, your car insurance company will pay without questions.
As mentioned, the insurance payments from your insurance are limited. Basically, they are limited to the benefits you purchased. Most auto insurance policies pay the first $20,000 in medical bills. In addition to No-Fault benefits, your auto insurance will also pay uninsured or underinsured motorist coverage, if necessary. For example, if the car that hits you doesn’t have insurance, your auto insurance will step in and pay additional compensation that the other driver should have paid. Again, this is limited to the amount of insurance you purchased. (Here’s a tip: Check your insurance coverage. In many cases, people don’t have enough insurance to protect themselves.) Your uninsured coverage will pay additional medical bills, wage loss, and pain and suffering.
Your car insurance also comes with underinsured coverage. This takes longer to explain but, basically, it provides compensation on top of the other driver’s insurance if you or your passengers are seriously injured.
