Minnesota law requires a car entering the highway to yield to cars already on the highway to avoid a crash. For example, see Minn.Stat. 169.20. Of course, there are some exceptions to this. For one, if the car on the highway is speeding, it loses its right of way. Also, if the car that pulls out does so with plenty of time, the car on the highway must slow down and let the car enter.

In general, however, the car entering the highway from a side road must yield. The supreme court has said, “A driver going down a highway has the right to assume that drivers approaching the highway would comply with traffic regulations and stop before entering the intersection and would yield the right-of-way to vehicles traveling thereon.” Evidence that the car on the highway saw or should have seen the approaching car is not the same as evidence that the car on the highway should anticipate the approaching car will fail to stop.
